I acknowledge that by participating in Walk Intuit's volunteer program, photography may be taken while I am on site for the purpose of marketing the organization and the volunteer program. By participating, I expressly consent (on behalf of myself or my children/charges) for Walk Intuit staff to take photos or videos during non-therapeutic/non-HIPAA-regulated sessions that may be used in our promotional materials, publications, social media, or other communications, without compensation or notice, and waive any right to inspect or approve such uses. Participant names will never be publicized.

Morning Hours: Feeding and stall cleaning is done between 6β8 AM (horses must be fed by 7:00 AM). Stall cleaning must be complete by 10:00 AM. Volunteers must be off the ranch by 10:00 AM.
Evening Hours: Feeding and stall cleaning is done between 6β8 PM (horses must be fed by 7:00 PM). Stall cleaning must be complete by 9:00 PM.

Walk Intuit, Inc. β Volunteer Waiver & Liability Release
This agreement is between Walk Intuit Inc., its directors, officers, employees, contractors, volunteers, therapists, equine specialists/professionals, and representatives (collectively, "Walk Intuit"), a nonprofit corporation organized and existing under the laws of the State of California, and the undersigned participant and/or minor participant's parent/legal guardian ("Volunteer"), as of the date of signature provided below.
I wish to participate in the Walk Intuit Inc. Volunteer program (hereinafter "Activity"), and/or authorize my child under 18 years old to volunteer at the Walk Intuit program located at the OC Fairgrounds Equestrian Center, 905 Arlington Dr, Gate #9, Costa Mesa, CA 92626. Walk Intuit may also conduct volunteer activities, community events, or supplemental programming at additional off-site locations.
This Agreement applies to the Volunteers' participation in any and all programs, activities, services, and events conducted or sponsored by Walk Intuit, including but not limited to:
- Equine-Assisted Learning/Mental Health Programming
- Summer & Spring Camp Programs
- Horsemanship and any training, groundwork, riding, or handling sessions
- Events
- Volunteer work including but not limited to stall cleaning and feeding. All Volunteers must be 18 years of age or be chaperoned by their parent or custodian AT ALL TIMES while on the Ranch and attending horses, chickens or any other animals that may be in our program.
This Agreement is executed as a precondition for volunteering and participating in Walk Intuit's activities, including those involving horses and other animals.
Volunteer Status and Scope of Relationship
1. The Volunteer affirms and acknowledges that participation in Walk Intuit's activities is strictly voluntary and without exception of compensation or employment benefits of any kind. Nothing herein shall be construed to create an employment, agency, or partnership relationship between the Volunteer and Walk Intuit.
2. The Volunteer recognizes that Walk Intuit does not provide workers' compensation coverage for volunteers and understands that Walk Intuit insurance, if any, may not extend to volunteers.
Assumption of Risk
1. The Volunteer acknowledges and fully understands that equine-assisted activities are inherently dangerous activities that involve significant risks, including but not limited to:
- Severe bodily injury, permanent disability, paralysis, or death;
- Falls, kicks, bites, collisions with horses, persons, objects, or ground;
- Unpredictable behavior of horses and other animals regardless of prior training or experience;
- Risks arising from uneven terrain, weather conditions, use of equipment, or interaction with other participants or volunteers.
2. The Volunteer expressly understands and agrees that:
- Horses and other animals may act unpredictably, and the risk of serious personal injury or property damage is always present and cannot be eliminated, even with careful instructions and supervision.
- Walk Intuit makes no representation as to the safety of any premises, facility, animal, equipment, or environment.
3. The Volunteer voluntarily assumes all risks, both known and unknown, foreseeable and unforeseeable, arising out of or relating to participation in Walk Intuit activities and programs, or caused in whole or in part by the acts or omissions of Walk Intuit, whether caused by the negligence of Walk Intuit or otherwise.
Volunteer Representations
1. Volunteer (or minor participant) is physically and emotionally able, willing, and prepared to participate in the above equine activities without limitations or supervision other than that provided by Walk Intuit staff or equine professionals.
2. Volunteer agrees to follow all instructions, safety rules, and policies given by Walk Intuit staff, and understands that failure to do so may increase the risk of injury.
3. Volunteer agrees to wear appropriate clothing (long pants, fitted shirts, and closed-toe shoes) and any required protective gear (including ASTM/SEI certified riding helmets when mounted or as otherwise instructed).
Release, Waiver, and Indemnity
1. In consideration of being permitted to volunteer for and participate in activities associated with Walk Intuit, the Volunteer, for themselves and their heirs, executors, administrators, legal representatives, and assigns, does hereby irrevocably and unconditionally release, waive, acquit, and forever discharge Walk Intuit from any and all claims, liabilities, actions, causes of action, suits, damages, costs, losses, expenses, demands, or judgments, whether at law or equity, for personal injury, property damages, illness, disability, death, or any other harm arising from or connected to Volunteers' participation in any activities or services of Walk Intuit, except to the extent caused by the gross negligence or willful misconduct of a party as may not be disclaimed by law.
2. The Volunteer agrees that this release is intended to and does release any and all claims, including those arising from ordinary negligence, to the full extent permitted by law.
3. Parents or legal guardians of Volunteers under eighteen-years-of-age further agree to defend, indemnify, and hold harmless Walk Intuit from any claim brought by or on behalf of the minor participant, or by any other person or entity, arising out of the minor's participation in Walk Intuit activities.
4. The Volunteer acknowledges and agrees that Walk Intuit is not responsible for the loss, theft, or damage to any personal property or equipment brought onto the premises or otherwise used in connection with Walk Intuit activities.
Medical Treatment and Insurance
1. Volunteer authorizes Walk Intuit to obtain emergency medical treatment for Volunteer or minor participant if Walk Intuit, in its discretion, believes such treatment is necessary and Volunteer's emergency contact cannot be reached in case of accident, illness, or injury occurring during the participation in Walk Intuit activities.
2. Volunteers acknowledge and understand that they are responsible for all associated costs and expenses of such medical treatment and for carrying their own medical, health, or accident insurance.
3. The Volunteer agrees to notify Walk Intuit of any medical condition, disability, allergy, or other relevant health information that could affect their ability to safely participate, prior to engaging in any activity.
4. The Volunteer understands and acknowledges that Walk Intuit does not provide medical, health, accident, or workers compensation insurance coverage for Volunteers.
5. The Volunteer affirms that they are either covered by personal health insurance, or if uninsured, accept full responsibility for any medical expenses incurred as a result of participation.
Covenant Not to Sue
1. The Volunteer covenants and agrees never to institute, assert, or otherwise pursue, directly or indirectly, any action at law or in equity against Walk Intuit arising out of or relating to any claim released herein. The Volunteer further agrees to reimburse Walk Intuit for any attorney fees and costs incurred in defending or responding to any such claim brought in contravention of this Agreement.
Consent to Participate and Program Description
1. Volunteer acknowledges that Walk Intuit staff have explained the general nature, goals, and procedures of the volunteer equine programs, including that volunteer responsibilities involve ground based activities near horses and/or mounted activities, as appropriate to the program and volunteer.
2. The Volunteer agrees to abide by all rules, instructions, and safety directives established by Walk Intuit and to comply at all times with all applicable instructions and applicable federal, state, and local laws, regulations, and ordinances while participating in any activity.
3. Volunteer understands that equine ranch chores, equine-training, equine-learning, and horsemanship programs are experiential in nature and may involve physical risks. Volunteer consents to participate (or for minor participant to participate) in these programs.
Indemnification
The Volunteer agrees, to the fullest extent permitted by law, to indemnify, defend, and hold harmless Walk Intuit from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys fees), arising out of or resulting from:
- The Volunteer's participation in any activities of Walk Intuit;
- Any act or omission of the Volunteer while acting pursuant to or in connection with Walk Intuit training, programs, or activities;
- Any injury or property damage to others caused by the Volunteer;
- This obligation to indemnify, defend, and hold harmless survives the termination of this Agreement.
Miscellaneous
- This agreement is intended to be as broad and inclusive as permitted by the laws of the state in which the services are provided. If any portion is held invalid, the remainder shall continue in full force and effect.
- This agreement shall be binding upon Volunteer, minor participant, and their respective parents, guardians, heirs, executors, administrators, and assigns.
- Volunteer understands that this agreement will apply to all present and future visits, training, and activities with Walk Intuit unless revoked in writing and acknowledged by Walk Intuit.
- This Agreement shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflicts-of-laws provisions. Any legal suit, action, or proceeding arising out of or related to this Agreement or the activities of Walk Intuit shall be instituted exclusively in the courts of Orange County, California, and each party irrevocably submits to the jurisdiction of such courts.
- If any term or provision of this Agreement is determined by a court of competent jurisdiction to be invalid, illegal, or unenforceable in any respect, such invalidity, illegality, or unenforceability shall not affect any other term or provisions, and the remainder of this Agreement shall remain in full force and effect.
- This Agreement constitutes the entire agreement between the Volunteer and Walk Intuit with respect to the subject matter herein and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral. Any modification, amendment, or waiver of any provision of this Agreement must be in writing and signed by the Volunteer and an authorized representative of Walk Intuit.
- No waiver of any term, provision, or condition of this Agreement shall be deemed or construed to be a waiver of any other provision or subsequent breach, whether or not similar, unless specifically stated in a written instrument executed by the waiving party.
Application Declaration
I understand that this is an application for and not a commitment or promise of a volunteer opportunity. I certify that all information I have provided is true, correct, and complete to the best of my knowledge. I understand that volunteer positions at Walk Intuit are unpaid, and that misrepresentations or omissions may result in my immediate rejection as an applicant or termination as a volunteer.
Acknowledgment & Signatures
By signing below, I acknowledge and affirm that I have carefully read this entire Agreement, have had the opportunity to ask questions about the risks and terms, and am voluntarily signing of my own free will β without inducement, coercion, or duress. I fully understand and accept the risks of participation.
Walk Intuit Inc. is a 501(c)(3) nonprofit organization. Volunteer positions are unpaid. Submission of this form does not guarantee a volunteer position and is subject to Megan's Law Clearance, reference checks, and completion of Volunteer Orientation.
